Terms of Use

These Terms of Use ("Terms") are an agreement between you and Gawk Digital LLC ("Gawk Digital", "we", "us"). They apply to the Headtide app for iPhone and iPad and to the website at https://headtide.app.

By downloading or using Headtide, or using the website, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Headtide.

You must be at least 13 years old, or 16 where local law sets a higher age, to use Headtide. If you are under the age of majority where you live, you may use Headtide only with the consent of a parent or guardian.

Headtide is a personal log. It is not a medical device, and it does not diagnose, treat, cure or prevent any disease or condition. Nothing in the app or on the website is medical advice.

Always talk to a doctor or other qualified health professional about your symptoms, medicines and treatment. Never ignore professional advice or delay seeking it because of something you saw in Headtide.

If you think you may have a medical emergency, call your local emergency number right away.

Headtide lets you log an attack with one tap to start and one tap to stop, update a pain level, and add medicines and symptoms when you are ready. History and a calendar keep each attack. Medicine days are shown at the top of History. Insights are three simple numbers based only on what you log.

The app includes a dim attack screen, a Home Screen widget, CSV export, a backup file and an optional Face ID lock. Reminders stay off unless you turn them on. Headtide works offline, and your logs stay on your device.

We may add, change or remove features over time.

Headtide requires an auto-renewable subscription purchased through the App Store. There are two plans, Yearly and Monthly, and both include the same features. The App Store shows the price in your local currency before you confirm.

Payment is charged to your Apple ID at confirmation of purchase. Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the end of the current period.

You can manage or cancel your subscription at any time in your Apple ID settings. Cancellation takes effect at the end of the current period. Deleting the app does not cancel a subscription, and we cannot cancel an Apple subscription for you.

If prices change, Apple will notify you as required, and you can cancel before the new price applies.

Purchases are processed by Apple and are subject to Apple's terms. Refund requests are handled by Apple at https://reportaproblem.apple.com.

If your subscription ends, you can still view and export your full history and create a backup file. Starting new entries and some features need an active subscription. Your logs stay on your device either way.

Your logs are stored only on your device. We do not keep a copy, so we cannot restore lost or deleted entries. You are responsible for keeping your device backup and any backup files you export. The Privacy Policy explains how we handle information: https://headtide.app/privacy

Headtide is licensed to you, not sold. Your license to use the app is governed by Apple's Licensed Application End User License Agreement (the Standard EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

These Terms add to the Standard EULA. If they conflict on the app license, the Standard EULA controls. Apple is not responsible for the app or its content, maintenance or support. Gawk Digital is.

You agree not to copy, modify, reverse engineer or resell the app except as the law allows, not to interfere with or disrupt the app or website, not to get around subscription checks, and not to use Headtide in violation of any law.

Headtide, its name, logo, design, text and software belong to Gawk Digital LLC or its licensors and are protected by law. The entries you create are yours.

Headtide relies on services from Apple, RevenueCat, PostHog and others. Their own terms and policies apply to their services, and we are not responsible for them.

To the fullest extent permitted by law, Headtide and the website are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the app will be error free or uninterrupted, or that any data will never be lost.

To the fullest extent permitted by law, Gawk Digital LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcomes, profits or goodwill, arising from your use of or inability to use Headtide. Our total liability for any claim relating to Headtide is limited to the amount you paid for Headtide in the 12 months before the claim.

Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded, such as the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993, Canadian provincial consumer protection laws, Mexico's Federal Consumer Protection Law, or Brazil's Consumer Defense Code. Where those laws apply, our disclaimers and limits apply only as far as those laws allow.

You can stop using Headtide at any time by deleting the app and cancelling your subscription. We may suspend or end your access if you seriously breach these Terms. The sections on not medical advice, disclaimers, limitation of liability, consumer rights and governing law continue to apply after these Terms end.

We may update these Terms from time to time. When we do, we will change the effective date at the top. If a change is significant, we will give notice in the app or on this website before it takes effect. If you keep using Headtide after the change, you accept the updated Terms.

These Terms are governed by the laws of the state in the United States where Gawk Digital LLC is organized, without regard to conflict of law rules. If you live outside the United States, you also keep the protection of the mandatory laws of your country of residence, and you may bring claims in your local courts where those laws allow.
